ALL VEHICLES ARE RECOMMENDED TO BE INSPECTED PRIOR TO BIDDING

Any bid acknowledged and relied upon by the Auctioneer shall not be withdrawn.

The Auctioneer and Vendor reserve the rights (which may be exercised without giving any reason:

• To withdraw any lot or lots from the auction without notice;
• To refuse to accept the bidding of any person or persons;
• The Auctioneer may refuse to accept any bid for a lot being less than a sum named from time to time by the Auctioneer;
• If any purchaser should bid successfully for more than one lot at the auction.
• To appropriate any money received from that purchase in satisfaction or partial satisfaction of the purchase price due in respect of any one or more such lots to the total or partial exclusion of amounts due in respect of any other such lot or lots as the Auctioneer shall see fit;
• To elect at any time treat such contract for the sale of each such lot and interdependent with each other such contract or contracts and hence default under any such contract as default under all such contracts.
• The Auctioneer may bid for the Vendor or for any prospective purchaser with or without disclosure and any such bid.

The buyer acknowledges that The Car Place is acting as the agent of the Seller

The Auctioneer is not responsible for bids that were not processed due to technical problems and or delays.

Purchaser's experiencing any loss from the use of The Car Place Simulcast Auction Bidding site agree to indemnify and hold the Auctioneer harmless regarding losses or damages experienced through the use of The Car Place Simulcast Bidding Website. This includes losses as a direct result of errors or problems on the Internet or on the service or any other condition arising that is beyond the Auctioneers' control.

The Auctioneer shall not be liable for any special, incidental or consequential damages or for loss, damage, or expense directly or indirectly arising from the Purchaser's use of or inability to use the service.

The Auctioneer cannot guarantee the prevention of any inappropriate use of the system or of users registering with any false information or the prevention of any material, information and records posted on the Website.

AUCTION TERMS & CONDITIONS

1. THIS IS A TIMED ONLINE AUCTION.

2. All buyers must be registered to bid, and by doing so accept and agree to the terms and conditions outlined for this auction.

3. Online Bidders accept FULL RESPONSIBILITY FOR THEIR ACTIONS. No discussions will be entered into in regard to accidental bids placed or bids placed on wrong lots. Any bid placed irrespective of the circumstance CONSIDERED FINAL. This is without exception, IF UNSURE DO NOT BID.

5. The purchaser is simply highest bidder at the close of each lot PROVIDED THE BID IS ABOVE THE RESERVE.

6. If a lot fails to meet its reserve and is passed in, negotiations will be entered with the highest bidder given first option to purchase. The time frame for the high bidders option will be entirely at the auctioneers discretion.

7. The auctioneer retains the right to accept and disregard bids up until the point of sale, therefore any disputes are to be determined by The Car Place.

8. The Auctioneer reserves the right to bid on behalf of clients and or the vendor.

9. All items remain the property of the vendor until payment has been received in full and to the satisfaction of The Car Place.

10. Whilst we have taken every bit of care to ensure the condition and quality of the cars is fully and accurately represented, the Auctioneer/Vendor does not accept responsibility for items described incorrectly in the catalogue. Intending purchasers are encouraged to take full advantage of the open days we have set aside for this auction or making an appointment with our sales team 07 5629 2372. Furthermore, no compensation shall be paid in respect of any error or mis-description.

11. Please note carefully the order of sale.

12. The auctioneer reserves the right to change the catalogue without notice at the discretion of the vendors/consignor. This includes the withdrawal of any lots at the request of the vendor/consignor.

13. NOTICE: All vehicles are sold with RWC or but no registration on a where is, as is basis unless specified to the winning bidder. There is no cooling off period or statutory warranty on any of the Auction vehicles.

14. The auctioneer is merely the agent of the vendor on the respect of the sale of the goods. The auctioneer shall not be liable for any default of the purchaser or vendor.

15. CAVEAT EMPTOR (buyer beware) applies to each lot in this Auction.

16. All sales are to be paid in full within 48 hours of the Auction closing unless agreed in writing otherwise prior to auction close. All Payments are in Australian Dollars and are to be made by EFT to our nominated trust account. THERE WILL BE NO CREDIT CARDS ACCEPTED. IF YOU ARE WANTING TO PAY BY CASH OR BANK CHEQUE, please contact the office 07 5629 2372. Should payment not be made within the agreed time frame, The Car Place will refer the matter to a debt collection agency in which the buyer will be entirely responsible for all associated fees in recovering the debt in addition to the original invoiced amount. Buyers should be aware that non-payment could lead to legal action or a permanent mark on their credit file which may affect their future borrowing capacity. If you are unsure on your ability to complete the transaction and payment DO NOT BID.

17. The Car Place reserve the right to advertise the final sales price of any sale as they deem fit, as a part of future marketing campaigns across any/all media.

18. By accepting these T&C you are allowing permission for The Car Place to send out information and reminders relating to this auction and future auctions via email or SMS. Should you wish to opt out of these, please contact us directly.

19. Bidders must accept full responsibility for ALL bids placed online, this includes bidding by mistake, entering the wrong amount, or any other reason. Bidders are fully responsible for ALL activity on their registered bidding account and should log out of their account when not in use. The Buyers Premium of 7.5% for vehicles is inclusive of GST

20. Absentee bidding available for those who cannot register and bid online. please contact our sales department on 07 5629 2372 to discuss the process for absentee bidding. All absentee bidder registrations need to be set up and confirmed 24 hours prior to auction close.

COLLECTION

Collection of all vehicles to be within 3 business days unless agreed prior to the auction closing. Space in our facility is a premium and vehicles that fail to be collected prior to this or have transport booking conformation will incur a $66 per day incl GST storage fee. Vehicles will not be released until payment has been received in full

Paid invoices MUST be signed off for items to be released and a copy of the paid invoice must be presented by the person/s collecting the items including couriers or any third party.
